Sweet Cheeks Baking Company Terms and Conditions of Sale

THE CUSTOMER AGREES TO BE BOUND BY THIS SALE AGREEMENT AND ACCEPTS ITS TERMS AND CONDITIONS

This Sale Agreement is a legal contract between the Customer and Sweet Cheeks Baking Company. The Customer accepts this Sale Agreement by making a purchase, placing an order, or otherwise shopping on the Site. The terms and conditions of this Sale Agreement are subject to change without prior notice, except that the terms and conditions posted on the Site at the time the Customer initially places or modifies an order will govern the order in question.

In the event of any conflict between the terms and conditions stated on your purchase order and this Sale Agreement or any terms and conditions on our invoice, you agree that the provisions of this Sale Agreement and our invoice shall control.

PRICING AND INFORMATION

All pricing is subject to change.
For all prices, products and offers, Sweet Cheeks Baking Company reserves the right to make adjustments due to changing market conditions, product discontinuation, manufacturer's price changes, errors in advertisements and other extenuating circumstances. Sweet Cheeks Baking Company uses its best efforts to put accurate and up-to-date information on the Site, but Sweet Cheeks Baking Company makes no warranties or representations as to the Site's accuracy. Sweet Cheeks Baking Company assumes no liability or responsibility for any errors or omissions in the content on the Site.

ORDERS

Orders are not binding upon Sweet Cheeks Baking Company until accepted and confirmed by Sweet Cheeks Baking. Once an order has been placed and accepted by Sweet Cheeks Baking, the order is not cancelable unless the shipment is unavoidably delayed or we are contacted immediately. The order can be cancelled only on the following conditions:

Sweet Cheeks Baking Company cancels due to its inability to ship the goods.

PAYMENT POLICY

We accept Visa, Master Card, American Express or check if contacted and the check is received prior to the ship date
We do not accept online COD or credit cards issued by any financial institutions outside of the United States

SHIPPING POLICY

Due to perishable nature of fresh baked products, all food products must be sent to an address where someone is available to accept the shipment. Please be 100% sure that if you send a food product as a gift, your recipient is aware of delivery and available to accept it.

Sweet Cheeks Baking is not responsible for deliveries made to addresses where recipient will not be able to accept delivery.

Due to the perishable nature of cream cheese we will only ship carrot cake with an overnight delivery option, regardless of the time of year (within southern CA, this may include FedEx Ground Shipping. Check FedEx.com or call for availability).

Carrot cakes are not available for Monday delivery, as they must be shipped OVERNIGHT ONLY.

All shipments are insured and guaranteed against loss, theft, and damage. Sweet Cheeks Baking Company will not be responsible, however, for any damage, loss, or expenses arising from delays in shipment or other non-performance of this Sale Agreement by or imposed by:
Acts of God, Riots, Natural Disaster, Fires, Strikes, Governmental action, or any other cause beyond Sweet Cheeks Baking Company
Address corrections made while in transit will be an additional expense to the credit card holder as we incur charges from the shipping carrier for the service.
Extra shipping charges may be applied to orders that are considered oversize products.
For the Customer's protection, we ship only to the verified billing address of the Customer's credit card

***Our products are freshly baked. Please allow for our bakers to provide you with the best quality in your goodies. We will do our best to ship out your order within 48 hours on orders received by 12pm PST Monday-Friday. Saturday delivery is not available in some zip codes.

Shipping Options When choosing your desired arrival date and shipping method, please be aware that business days refer to weekdays (Monday through Friday) and exclude certain legal holidays.

When ordering, the first available arrival date for the shipping method selected is initially offered. If desired, you may change this date to a later arrival date.

We can only assure delivery on a specific date if you choose Next Day Air, Second Day Air, or Saturday Delivery as your shipping option.

Ground: Your order ships five business days before the requested delivery date. Since an order takes from one to five business days to arrive, your order might arrive earlier than your requested delivery date. All orders ship from San Diego California.

Next Day Air: Your order ships one business day before your requested arrival date.

Second Day Air: Your order ships two business days before your requested arrival date.

To ensure your order arrives in fresh condition: - Cakes ship ONLY via Next Day Air or Saturday Delivery regardless of time of year.

Monday delivery is not available for these items.

If warm weather conditions (75 degrees or over) exist at other times of the year, we reserve the right to offer only expedited shipping methods for these items.

Depending on your product selection, your package’s destination, and temperature conditions, we will contact you if weather conditions necessitate a change in your shipping method.

GOVERNING LAW

This Agreement and any sales hereunder shall be governed by the laws of the state of California, without regard to conflicts of laws rules. The customer consents to the jurisdiction of the federal or state courts located in San Diego County, California for purposes of any suit, action or proceeding arising out of this Sale Agreement.

PRIVACY POLICY

Sweet Cheeks Baking Company does not sell, rent, or trade customer information, or any other information, which may identify you, to any outside party under any circumstances. Your information is only used to ensure secure ordering and to provide a more personalized shopping experience. Sweet Cheeks Baking Company does not reveal customer information except to complete transactions with our third party banking institution. The banking institution we do banking with is under strict responsibility to keep your information private and protected.

Sweet Cheeks Baking Company is committed to providing all customers with a world-class shopping experience. In order to measure how well we are doing and to better serve you with our product offerings, from time-to-time we may contact you via email and solicit your participation in research. Sweet Cheeks Baking Company may also occasionally notify you via email with recommendations or special offers of new products, prices, or any other promotions. You may request to remove yourself from future efforts of this kind at any time.
